Terms of Service

1. Introduction

This End User License Agreement ("Agreement") is a legal agreement between you and Epic Technology Limited ("Company," "we," "us," or "our"). It governs your use of The Drill Sergeant browser extension and the website located at mydrillsergeant.com and its subdomains (including our dashboard at hq.mydrillsergeant.com) (collectively, the "Service" or "Product").

By accessing or using the Product, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, please do not use the Product.

You represent that you are at least 13 years of age and have the legal capacity to enter into this Agreement.

2. License Grant

Subject to the terms of this Agreement, we grant you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the Product on devices owned or controlled by you strictly for your personal, non-commercial use.

We reserve all rights not expressly granted to you in this Agreement. The Product is licensed, not sold, to you.

3. User Restrictions

You agree not to, and not to permit others to:

• License, sell, rent, lease, transfer, assign, distribute, or otherwise commercially exploit the Product.
• Modify, translate, adapt, merge, make derivative works of, disassemble, decompile, or reverse engineer any part of the Product.
• Access the Service in order to build a similar or competitive website, product, or service.
• Bypass or breach any security device or protection used by the Product.
• Use the Product for any illegal purpose or in violation of any local, state, national, or international law.

4. Premium Subscriptions

We offer "Unlimited" premium plans that unlock additional features.

Payment & Billing

Payments are processed by third-party payment processors (Stripe or PayPal). By purchasing a subscription, you agree to pay all fees and applicable taxes. Subscription fees are billed in advance on a recurring basis (monthly or annually) unless you purchase a Lifetime plan.

Cancellation

You may cancel your subscription at any time through your account dashboard. Your access to premium features will continue until the end of your current billing period. Payments are non-refundable, except where required by law.

5. Intellectual Property

The Product, including its "Drill Sergeant" persona, text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code, is owned, controlled, or licensed by or to Epic Technology Limited and is protected by copyright, patent, and trademark laws.

6. Disclaimer of Warranties

THE PRODUCT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EPIC TECHNOLOGY LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PRODUCT.

8. Changes to Agreement

We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this policy or through the Product. Your continued use of the Product after any such change constitutes your acceptance of the new Agreement.
